Airbnb is still legal in Penang, but the legal short-stay market is now much narrower and more regulated than it used to be.

Penang did not impose a statewide Airbnb ban. It created a licensing regime, so the real question is no longer whether Airbnb exists legally, but whether a specific property and operator can qualify.

Penang Island is where the biggest change has happened. MBPP now blocks ordinary residential strata property from private-accommodation use, which removes a large part of the conventional condo market from the legal short-stay model.

Serviced apartments, SOHO units, selected commercial premises and some landed homes still have routes to approval on the island. Even then, the approved planning use matters more than the label used in an estate-agent listing.

Building-level rules remain a second filter. A project can pass council planning rules and still be unusable for Airbnb if its JMB or management corporation has banned short-term rentals.

The old 180-day rule is no longer a useful one-line summary of Penang Airbnb regulation. The newer framework gives eligible operators more room to operate, while making basic property eligibility much stricter.

Mainland Penang remains relatively more open than Penang Island. MBSP has historically allowed a broader range of strata formats, although a council licence and local planning compliance are still required.

Foreign ownership and operating rights are separate issues. A foreign buyer may own an Airbnb-compatible property but still need a compliant Malaysian operating structure to hold the TIP licence.

The new regime also raises the cost of being legal. A small operation faces roughly RM2,800 a year in council-level licence and TIP fees before Airbnb commission, cleaning, utilities, management, furnishing and taxes.

Enforcement is getting more serious, but the market is still in transition. Live listings therefore overstate the number of properties that will ultimately survive as fully compliant short-stay units.

For buyers, legality should now come before yield. The best Airbnb return on a spreadsheet is irrelevant if the exact unit, building, property category or operator cannot obtain approval.

Did Penang actually ban Airbnb?

Airbnb is still legal in Penang today, but hosts now need a local-authority licence and the property itself has to qualify under the rules that apply to its location.

Penang’s new Private Accommodation By-Laws came into force in 2026 and explicitly regulate paid short stays booked through platforms such as Airbnb. The state chose licensing rather than a statewide prohibition.

The bigger change is how much harder it has become to assume that a property qualifies. Operators now need approval from either the Penang Island City Council, MBPP, or the Seberang Perai City Council, MBSP. On Penang Island in particular, MBPP has also tightened the planning rules governing which properties can be used for private accommodation.

There is one important timing point right now. Penang gave existing operators a grace period to submit licence applications, so the new licensing system is already in force while full enforcement against unlicensed operators is still moving through that transition.

Why are people saying Airbnb is illegal in Penang?

People are calling it an Airbnb ban because ordinary residential condos on Penang Island have been hit especially hard, even though short-term accommodation remains legal elsewhere.

That distinction is easy to miss. The state-level by-laws regulate private accommodation across Penang, while MBPP separately decides where private accommodation can operate on the island.

MBPP’s latest planning guideline lists its Private Accommodation, or TIP, rules among the council’s current planning policies. Those rules make the island far more restrictive for conventional residential strata properties than for serviced apartments, SOHO projects and certain other commercial premises.

Seberang Perai has historically taken a broader approach. Under Penang’s earlier statewide strata guideline, MBSP permitted potential TIP use across categories including apartments, condominiums, townhouses, serviced apartments and several commercial strata formats, subject to the applicable rules.

So when someone says “Penang banned Airbnb,” they are usually compressing several different regulations into one sentence. For an owner, the exact building now matters far more than the Airbnb brand.

What changed for Penang Airbnb hosts recently?

Penang Airbnb hosts now face a real licensing regime backed by inspection, closure and penalty powers.

The state introduced the Private Accommodation By-Laws after years of regulating much of the sector through guidelines and strata-management rules. According to the Penang government’s announcement of the new regime, operators must now obtain a licence from MBPP or MBSP and comply with requirements covering safety, cleanliness, operating conditions and nuisance.

The councils also gained clearer enforcement powers. Authorised officers can investigate suspected violations, inspect premises and close properties where the rules are breached.

That changes the balance quite a bit. In the past, many disputes revolved around whether a JMB or management corporation would tolerate short stays. Today, the council itself has a much more direct role.

The rules are also recent enough that we should separate the law from enforcement on the ground. The regime is already effective, but operators were given a transition period to file applications. The visible Airbnb market will take some time to fully reflect the legal one.

Can you still run an Airbnb in a Penang Island condo?

A normal residential condo on Penang Island is currently a poor candidate for legal Airbnb operation because MBPP’s latest planning rules prohibit TIP in residential strata property.

This is probably the single most important change for property investors.

MBPP’s current TIP planning framework separates residential strata from commercial categories. Conventional strata residences fall on the prohibited side, while serviced apartments and several commercially approved property types can still be considered.

That means a residential condominium in a popular location does not become Airbnb-eligible simply because tourists want to stay there. A sea-view unit in Tanjung Tokong or a condo near George Town can still fail at the first regulatory hurdle if its approved property category is residential strata.

For investors, advertised nightly rates from similar Airbnb units are therefore much less useful than they once were. Before modelling short-stay income, we would first establish exactly how MBPP classifies the development.

Which Penang Island properties can still legally use Airbnb?

Serviced apartments, SOHO properties, certain commercial premises and some landed homes remain the clearest routes to legal Airbnb operation on Penang Island.

MBPP’s current planning guideline specifically leaves room for commercial categories including serviced apartments, SOHO units, shops, shophouses and shop offices.

Landed homes can also be considered in some circumstances. Detached houses, semi-detached houses and terrace houses may qualify, although residential properties can require planning permission for a change of building use.

Location still matters. MBPP excludes TIP from a number of established residential areas, while properties inside the George Town World Heritage Site face an additional planning and heritage layer.

The market is much more selective than it was a few years ago. A buyer looking specifically for Airbnb income now has a fairly narrow group of property types worth investigating rather than the entire Penang Island condo market.

Does a serviced apartment automatically qualify for Airbnb in Penang?

A serviced apartment has a much better chance of qualifying for Airbnb on Penang Island, but the words “serviced apartment” on a property listing do not guarantee legal short-term rental use.

MBPP currently identifies serviced apartments as a commercial property category that can be considered for private accommodation. The council also updated its separate serviced-apartment planning guideline in 2026, another sign that serviced accommodation remains part of Penang Island’s planning framework.

We would still verify the approved planning use, strata documentation and management rules for the exact development. Marketing terminology in Malaysian property projects can be messy, and two developments sold under similar commercial-sounding labels may have different approvals.

The building itself also gets a say. Malaysia’s Federal Court established in the Verve Suites case that a strata management corporation can validly prohibit short-term rentals through its house rules, even in a development with commercial land-use conditions.

So a serviced apartment solves one major problem, but not every problem.

Can a Penang condo management ban Airbnb even if the council allows it?

Yes, a Penang JMB or management corporation can still block Airbnb in a strata building even when the property category is otherwise compatible with short-term accommodation.

Malaysia’s Federal Court made this clear in Innab Salil v Verve Suites Mont’ Kiara Management Corporation. The court upheld house rules prohibiting short-term rentals, confirming that strata communities can impose restrictions on how individual units are used.

That precedent matters directly in Penang. A serviced apartment or SOHO development may pass MBPP’s planning test and still have an AGM resolution, supplementary by-law or house rule banning short-term stays.

We would therefore never rely solely on an estate agent saying that a project is “Airbnb friendly.” The useful documents are the current JMB or MC house rules, recent AGM and EGM resolutions and any written short-stay policy.

That second layer of approval is one reason legal Airbnb supply can be considerably smaller than the number of theoretically eligible commercial units.

Does Penang still have the 180-day Airbnb limit?

The old 180-day rule should no longer be used as a simple summary of Penang’s Airbnb rules today.

Penang’s 2023 strata framework became well known for limiting TIP operations to 180 days a year, together with restrictions on how frequently individual stays could occur.

Those rules are still repeated in property blogs, old news articles and sales material. The regulatory framework has since changed substantially.

Under the new statewide licensing regime, permitted private accommodation can operate throughout the year, while MBPP has tightened the more fundamental question of which Penang Island properties can qualify in the first place.

So the old limit has become a distraction. Eligible properties have more operating freedom, but a large part of the ordinary residential condo market has lost access to the short-stay model altogether.

Is Airbnb easier on mainland Penang than on Penang Island?

Airbnb remains easier to pursue in Seberang Perai than in many parts of Penang Island, although MBSP licensing and planning approval still matter.

The difference goes back several years. Penang’s 2023 strata guideline allowed a much wider set of property categories under MBSP than under MBPP. The MBSP list included apartments, condominiums, townhouses, serviced apartments, landed strata, SOHO, SOFO, SOVO and several office formats.

The new statewide by-laws now require licences on both sides of the state, but each local authority retains control over permitted areas and planning requirements.

MBSP has been reviewing how its internal procedures and location criteria should operate under the new framework. That makes mainland Penang relatively more permissive, although we would avoid assuming that every mainland condo can automatically become an Airbnb.

The contrast with the island is nevertheless substantial.

Can you Airbnb a landed house in Penang?

Some landed homes on Penang Island can still be used for private accommodation, but residential owners may need planning permission before operating.

MBPP’s latest guideline allows categories such as detached houses, semi-detached houses and terrace houses to be considered. For residential properties, however, a change-of-use planning application can be required.

That makes landed property quite different from an ordinary residential condo. There is no strata management corporation controlling the building, but MBPP becomes the main obstacle instead.

Certain residential areas are also excluded from TIP use. MBPP has identified established neighbourhoods where private accommodation is prohibited, including locations such as Jesselton Heights, Pearl Hill, Minden Heights and parts of Sungai Ara and Bukit Jambul.

A landed Penang Airbnb therefore has to pass both a property-type test and a location test before the economics are worth discussing.

Is Airbnb legal inside George Town’s heritage area?

Airbnb can still operate in parts of George Town, but properties inside the World Heritage Site face extra heritage and planning scrutiny.

The UNESCO-listed area contains exactly the kind of properties that short-stay visitors want: historic shophouses, converted commercial premises and accommodation close to the core tourist district.

Yet “George Town” tells us very little about the legal position of an individual building. MBPP requires proposals inside the World Heritage Site to comply with the George Town World Heritage Site Special Area Plan, and relevant applications can be referred to the council’s heritage-conservation authorities.

That is especially important for old shophouses. Their commercial appearance does not automatically prove that tourist accommodation is an approved use, and physical alterations can create additional heritage issues.

Demand may be strongest in central George Town, but legality still has to be checked building by building.

Are Penang affordable-housing units allowed on Airbnb?

Low-cost, low-medium-cost, controlled-price and government housing are excluded from Penang’s private-accommodation licensing system.

The new by-laws specifically prevent licences from being issued for several protected housing categories, including low-cost housing, low-medium-cost housing, price-controlled homes and People’s Housing Projects.

The policy is easy to understand. These homes exist primarily to expand housing access for residents, so converting them into tourist accommodation works against their intended purpose.

For an investor, the conclusion is unusually straightforward. We would assign zero Airbnb value to a unit in one of these protected categories, regardless of whether similar units currently appear on booking platforms.

An active Airbnb listing in the same development proves that someone is taking reservations. It does not prove that the operation is legal.

Can a foreigner buy a Penang property and personally run the Airbnb?

Foreign ownership of a Penang property does not automatically give a foreign buyer the right to become the licensed TIP operator.

MBPP’s current planning guideline requires the TIP operator to be a Malaysian citizen or a Malaysian company owned by Malaysian citizens. The operator must also meet the relevant business-registration requirements.

The new by-laws similarly allow licensing authorities to reject applications involving Malaysian companies that do not satisfy the Malaysian-ownership requirement.

That creates a real issue for foreign property buyers. The rules governing who may own a Penang property and the rules governing who may operate private accommodation are separate.

A foreigner could therefore own a potentially Airbnb-compatible serviced apartment while still needing a compliant local operating structure. We would have that structure reviewed before buying rather than treating it as an administrative detail to fix afterwards.

How much does a legal Airbnb licence cost in Penang?

A small Penang Airbnb now starts with roughly RM2,800 a year in recurring council-level licence and TIP fees before normal operating costs.

According to the state government’s rollout of the new by-laws, an application carries an RM50 administrative fee. The annual licence costs RM1,000 for premises with up to three rooms, while each additional room costs RM200, with the private-accommodation category capped at five rooms.

There is also an annual TIP fee of RM1,800 per unit.

The numbers are manageable for a busy tourist property. They become more important for a marginal unit that only produces occasional bookings. A host collecting RM60,000 of annual room revenue barely notices RM2,800 at the top line; a unit producing RM15,000 feels it much more.

And these are only regulatory fees. Airbnb commission, cleaning, utilities, maintenance, management, taxes and furnishing still sit on top.

Are Penang’s new Airbnb rules actually going to be enforced?

Penang now has much stronger tools to enforce Airbnb rules, but we are still too early in the new regime to pretend that every illegal listing has already disappeared.

The councils can investigate suspected offences, enter premises, inspect them and close non-compliant private accommodation. Breaches can also lead to fines of up to RM2,000, imprisonment for up to one year, or both.

The state did not build that machinery in response to a theoretical problem. Penang government figures show that MBPP received 364 complaints involving nuisance and safety concerns connected with illegal TIP operations between 2020 and March 2026. MBSP received another 24.

That gives us 388 complaints across the two councils, with roughly 94% occurring on Penang Island.

The concentration helps explain why MBPP has become so aggressive about separating residential buildings from tourist accommodation.

Still, enforcement should be judged over the coming months rather than assumed. Operators are currently moving through the licensing transition, so the number of live Airbnb listings will almost certainly overstate the number of properties that eventually survive as fully compliant short-stay units.

Why is Penang getting so strict with Airbnb?

Penang’s crackdown is mainly aimed at keeping hotel-like activity out of ordinary residential buildings while preserving short stays in properties better suited to tourism.

The pattern across the rules makes that fairly obvious. MBPP blocks residential strata, keeps a route open for serviced apartments and SOHO units, allows some landed properties through planning approval and places extra controls around sensitive residential and heritage areas.

The complaint figures point in the same direction. As seen above, almost 94% of the complaints recorded by the two Penang councils came from the island, where population density, tourism pressure and large strata developments overlap most heavily.

Authorities have repeatedly pointed to noise, traffic, safety concerns, social disturbance and heavier use of common facilities as problems associated with badly controlled TIP operations.

Penang is pushing Airbnb toward properties that can operate more like legitimate accommodation businesses. That leaves fewer investment options, but the properties that remain compliant should be easier to distinguish from the grey market.

If an Airbnb listing is live in Penang, does that mean it is legal?

A live Penang Airbnb listing currently proves almost nothing about the property’s legal status.

Airbnb can show a unit because a host created a listing and is accepting bookings. The platform listing by itself does not establish MBPP or MBSP planning approval, a council licence, strata-management permission or compliance with the new by-laws.

This gap is especially important now because the licensing regime is still in its transition phase. Older listings have not magically vanished from booking platforms simply because the regulatory framework changed.

For property buyers, screenshots of neighbouring Airbnb units should therefore carry very little weight.

We would want to know the exact council classification of the project, whether that property type is eligible, what the JMB or MC currently permits and whether the operator can actually obtain the new TIP licence.

That evidence is much harder to fake than “there are already 20 Airbnbs in this building.”

Is buying a Penang property for Airbnb still worth considering?

Penang Airbnb investing is still viable, but buying an ordinary residential condo on the island and assuming nightly rentals will work has become a bad strategy.

The strongest opportunities now sit in a narrower group of properties: appropriately approved serviced apartments, SOHO developments, selected commercial premises, some landed properties and potentially a broader range of projects in Seberang Perai.

The tighter rules could eventually help compliant operators. Illegal or unsuitable residential supply may shrink once licensing and enforcement mature, leaving fewer legitimate short-stay competitors in the buildings and zones that remain eligible.

We would still be cautious about paying a large “Airbnb premium” today. The latest regime is very new, enforcement is only beginning to reveal how strict the councils will be, and building-level restrictions can still wreck an otherwise sensible plan.

For anyone buying specifically for short stays, legality should now be checked before yield. A spectacular projected Airbnb return is worthless if the unit cannot obtain approval.

Yes, Airbnb is still legal in Penang today, but legal short-term rentals now occupy a much narrower lane than many owners and property agents imply.

Penang has formally licensed private accommodation instead of eliminating it. The state-level rules allow TIP operations to continue, while MBPP and MBSP decide where those operations can take place and under what planning conditions.

Penang Island is the difficult part. Ordinary residential strata properties are currently shut out under MBPP’s planning framework, which makes the classic “buy a condo and Airbnb it” strategy largely obsolete there. Serviced apartments, SOHO units, selected commercial premises and some landed homes still have routes to approval. Mainland Penang remains more open, although MBSP rules and licensing still need to be checked.

As of now, we would describe Penang as a regulated Airbnb market rather than a banned one. The crucial question for a buyer has become very specific: does this exact unit, in this exact building and under this exact council, qualify for legal short-term accommodation?

If the answer to any part of that chain is unclear, we would not price Airbnb income into the purchase.

OUR METHODOLOGY

This analysis tests whether Airbnb is still legal in Penang by separating the issue into the regulatory layers that actually determine the answer: statewide licensing, local planning rules, property classification, strata-management powers, operator eligibility and enforcement.

We gave the greatest weight to the freshest authoritative material available, especially the 2026 Penang Government Gazette, current MBPP and MBSP guidance, official planning documents and state implementation statements. Older rules were used mainly to understand what changed and why some older summaries of Penang Airbnb regulation are now misleading.

We treated legal compatibility as a chain rather than a single approval. A property was not counted as genuinely Airbnb-compatible simply because one rule appeared favourable; state licensing, council planning rules, the property’s approved category, building-level restrictions and operator requirements all had to line up.

That is also why marketing descriptions such as “serviced apartment” and the existence of neighbouring Airbnb listings were treated as weaker evidence than approved planning use, council documentation and current strata rules.

Freshness matters unusually heavily here because Penang’s framework changed materially in 2026. We separated rules already in force from the market’s transition toward those rules, including the grace period given to existing operators to submit licence applications.

We also assessed Penang Island and Seberang Perai separately rather than treating Penang as one uniform market. MBPP and MBSP have different planning contexts, and similar-looking property types can receive very different treatment depending on the council involved.

For strata buildings, we used Malaysia’s federal strata framework and the Federal Court’s Verve Suites judgment to test whether a JMB or management corporation can still prohibit short-term rentals even where the underlying property category is otherwise compatible with private accommodation.
